The organizer of and contact for the Twitter competition is InterSystems Benelux. Entrants must be aged 18 or over. The competition will open on 11 February 2020 at 9 am and will close on the same day at 6 pm. One winner will be determined on the day, who will be announced on 11 February 2020 during the Beer & Bytes Session. Should the winner be unable to receive their prize on the day it is announced, they will be notified via e-mail. For this reason, an e-mail address must be provided to take part in the competition.
The winner will incur no additional costs. The organizer, InterSystems BV, reserves the right to adapt, change, or terminate the Twitter competition before the closing deadline, as well as restart the competition or exclude persons from it, should it be necessary. Employees of InterSystems BV and their family members are not eligible to participate in the competition. The data privacy policies of InterSystems BV shall apply. The decision is final. Have fun!
General Terms and Conditions:
The competition is organized by InterSystems BV, Medialaan 32 / 1, B-1800 Vilvoorde, Belgium.
Participation in the competition is free and is independent from the purchase of goods and services. By participating in the competition, the participant accepts these Conditions of Participation.
All tweets containing the hashtag #BNLSymposium2020 shall be considered when determining the winner. Only original tweets composed by the participant themselves shall be considered. The participant who composes the most original tweets containing the hashtag #BNLSymposium2020 on 11 February 2020 between 9 am and 6 pm shall be declared the winner.
The prize can neither be paid out in cash nor transferred to other persons. The winner will be announced on 11 February 2020 during the Beer & Bytes Session. If the winner does not confirm their prize to InterSystems BV in writing (via letter or e-mail) within 21 days of receiving the notification, they will no longer be entitled to claim the prize. This will be expressly pointed out to the winner again in the prize notification. The participant is responsible for the accuracy of the address provided.
All persons aged 18 and over residing in the Benelux countries (the Netherlands, Belgium, or Luxembourg) are eligible to participate. The participant must provide truthful information concerning their personal data to participate in the competition. InterSystems GmbH employees, including their relatives, are not eligible to participate in the competition.
InterSystems BV is entitled to exclude individual persons from participating, provided that there are legitimate reasons to do so, such as breaches of the Conditions of Participation, double participation, undue influence on the competition, manipulation, and so on. In these cases, prizes may be denied and reclaimed, even in retrospect, if necessary.
Changes to the rules of participation and termination of the competition
InterSystems BV reserves the right to alter the Conditions of Participation at any time. Furthermore, InterSystems BV reserves the right to terminate or suspend the competition without prior notice for cause at any time. This applies in particular for such causes that would disrupt or prevent the competition from running as planned. If this type of termination is the result of the behavior of a participant, InterSystems BV is entitled to demand compensation from this person for the damages incurred.
Participants cannot use a suspension, cancellation, or termination prior to the closing deadline as the basis for any claims.
In terms of Intersystems BV’s liability for compensation, the following liability exclusions and limitations shall apply irrespective of the other legal eligibility criteria pursuant to this clause: InterSystems BV shall bear unlimited liability if the cause of damage is based on willful intent or gross negligence. Furthermore, InterSystems BV shall be liable in the event of a negligent breach of essential duties, the breaching of which jeopardizes the purpose of the contract, or in the event of a breach of duties, the fulfilment of which renders the proper implementation of the competition possible in the first place, and the compliance with which the contract partners regularly rely. However, InterSystems BV shall only be liable for foreseeable damages that are typical of the contract. InterSystems BV shall not be liable for negligent breaches of duties other than those stated in the previous sentences. The aforementioned liability limitations shall not apply in the event of death, physical injury, and damage to health, for a defect found in the condition of a product following the assumption of quality guarantees, and in the event of fraudulently concealed defects. Liability according to the German Product Liability Act (Produkthaftungsgesetz) shall remain unaffected. So far as InterSystems BV’s liability is excluded or limited, this shall also apply to the personal liability of InterSystems BV’s employees, representatives, and vicarious agents.
InterSystems BV shall not be liable for legal or material defects of the prize.
All personal data provided by the participant shall be collected, processed, and used exclusively for the purposes of administering and running the competition. The data collected shall be stored until consent is revoked, but erased after six months at the latest. This shall not apply to information that has already been collected as customer data or in the InterSystems Preference Center.
Publication of the name of the winner
The use of personal data pursuant to this clause shall also apply in addition to the regulated use of personal data outlined in the “Data protection” section. Participants shall agree to their name and company being published on the following media platforms: the InterSystems website, InterSystems’ Twitter and Facebook Accounts. Consent shall be given without separate remuneration.
Belgian law applies.
If individual provisions within these Conditions of Participation are or become invalid, the validity of the remaining provisions shall remain unaffected.
The competition organizer’s decision is final.
